Worker Classification

Before adding a job to the system it must be assessed for IR35 purposes. To ensure Bond, our clients and suppliers are remain compliant with UK tax legislations.

  • A role falls within IR35 if an individual provides services through an intermediary (e.g. a limited company) and the working arrangement resembles employment.

In short, IR35 may apply when:

    • Services are delivered via an intermediary, and
    • The engagement appears employee-like rather than genuinely independent.

Roles are typically out of scope if no intermediary is used or the arrangement is clearly not employment-like.

  • If the role is in scope of IR35, a formal status determination must be completed to confirm whether the engagement is:

    • Inside IR35 – the role is considered employment-like for tax purposes, or
    • Outside IR35 – the role is considered a genuine business-to-business engagement.

This assessment must be completed before onboarding and prior to adding the job to the system

  • All determinations must follow internal protocol, which will typically involve:

The outcome of this process must be recorded and retained as part of the onboarding audit trail.
